Repeal of AB 1103, California’s Nonresidential Building Energy Use Disclosure Program

Since December 2013, Perkins Coie has sent out three client updates regarding California Assembly Bill (AB) 1103, the California Energy Commission’s (CEC) Nonresidential Building Energy Use Disclosure Program.  The purpose of this update is to disclose that in October 2015, Governor Brown signed AB 802, which repeals AB 1103.  AB 1103 will remain in effect only until December 31, 2015.  AB 802 directs the CEC to establish a statewide energy benchmarking and disclosure program and enhances the CEC’s existing authority to collect data from utilities and other entities for purposes of energy forecasting, planning and program design.  There will be no energy use disclosure requirements in 2016 while the CEC develops regulations for AB 802 that will become effective January 1, 2017.
