Repeal Of Requirements For Arizona Registration Of Charities Soliciting Donations In Arizona

As of September 13, 2013, the Arizona Secretary of State is no longer accepting registrations from charities that solicit charitable donations in Arizona.

Arizona House Bill 2457 repealed the former Section 44-6552 of the Arizona Revised Statutes. That section previously required each charitable organization to file an initial registration statement with the Arizona Secretary of State before soliciting its first contribution in Arizona, whether through a contracted fundraiser or otherwise. 

The former Section 44-6552 also required each charitable organization to file an annual registration statement between September 1 and September 30 of each year after the calendar year in which it filed its initial registration statement.  For purposes of the former registration requirement, a charitable organization was defined as either (a) a tax-exempt organization pursuant to Section 501(c)(3) of the Internal Revenue Code), or (b) an organization that is, or that is held out to be, established for a benevolent, educational, philanthropic, humane, scientific, patriotic, social welfare or advocacy, public health, environmental conservation, civic or other eleemosynary purpose or that in any manner employs a charitable appeal as the basis of a solicitation. 

The initial registration statements and renewals were considered public information and available for inspection.  Veterans’ organizations are still required to file registration statements with the Arizona Secretary of State prior to soliciting money or support in the name of American veterans.
