Air Enforcement: Mississippi Commission on Environmental Quality and Pontotoc Plastic Packaging Manufacturer Enter into Agreed Order

The Mississippi Commission on Environmental Quality (“MCEQ”) and Premiere Plastics, Inc. (“PPI”) entered into a March 30th Agreed Order (“AO”) addressing an alleged violation of an air permit. See Order No. 7104 21.

The AO provides that PPI operates a facility (“Facility”) in Pontotoc, Mississippi.

The Facility is stated to operate pursuant to a Title V Operating Permit. It is further alleged that PPI:

  • Failed to submit a certification of compliance by January 31, 2020, for the 2019 calendar year
  • Failed to submit a semi-annual report by January 31, 2020, for the second half of the 2019 calendar year

MCEQ is stated to have received the semi-annual report on March 17, 2020, and the certification of compliance on April 2, 2020.

A civil penalty of $5,170 is assessed.
