The Arkansas Department of Environmental Quality (“ADEQ”) on August 31st public noticed an emergency rulemaking undertaken by the Arkansas Pollution Control and Ecology Commission (“Commission”).
The Commission adopted on an emergency basis for 180 days Regulation 36 (“Reg. 36”) Used Tire Recycling and Accountability Program.
The notice states adoption of Reg. 36 allows ADEQ to implement and administer the new tire program that begins on January 1, 2018. The program is being implemented as required by legislation (Act 317) enacted in the 91st Arkansas General Assembly.
