California Attorney General Backs Legislation Creating Private Cause of Action Against Gun Manufacturers

  • California AG Rob Bonta is sponsoring legislation to allow individual California residents, as well as the AG, to file civil suits for damages against gun manufacturers and distributors who do business in California.
  • Assembly Bill 1594 creates a private cause of action for public nuisance against gun industry members that fail to take reasonable precautions to ensure their products are not used unlawfully if that failure leads to injury or death. It could also help people sue over “ghost guns”—untraceable firearm kits that people can buy without a background check and assemble at home.
  • Governor Newsom stated that he is confident the U.S. Supreme Court could not overturn AB 1594 because it is modeled after Texas’ new abortion law.
