  • A group of 23 Democratic AGs filed an amicus brief with the U.S. Supreme Court asking it to reverse a Fifth Circuit decision upholding a preliminary injunction barring communication between social-media platforms and federal officials and agencies regarding content moderation.
  • In the amicus brief, the AGs argue that the Fifth Circuit failed to distinguish between impermissible coercion and permissible efforts by the government to persuade social media companies, and further that the decision is counter to the public interest and chills mutually beneficial discourse between the government and the companies to address potentially harmful content on their platforms.
  • The states ask the Court to reverse the Fifth Circuit’s decision and vacate the preliminary injunction.
