James Leads Coalition of AGs Winning Injunction Blocking Postal Service Cutbacks

A coalition of AGs and other government officials, led by New York AG Letitia James, has won partial summary judgment in a lawsuit seeking to block changes to the operation of the United States Postal Service (USPS).
The coalition, which included the AGs of Hawaii and New Jersey, as well as the city of New York and the city and county of San Francisco, filed a complaint in August 2020 against former president Donald Trump, United States Postmaster General Louis DeJoy, and the USPS alleging that “significant changes to USPS operations under DeJoy’s leadership substantially impacted USPS mail service in New York and nationwide and posed a threat to the integrity of the November 2020 presidential election.” The complaint sought an injunction preventing the USPS from implementing the changes.
In a Memorandum Opinion, US District Court Judge Emmet G. Sullivan found that Defendants’ operational prohibition of extra or late mail delivery trips was a substantial factor in a nationwide degradation of mail service. Accordingly, the Court enjoined prohibition of these trips without the USPS seeking an advisory opinion from the Postal Regulatory Commission (PRC) as required by federal statute.
