Oil Spill/Salt Water Disposal Facility: Illinois Attorney General Request for Preliminary Injunction

The Illinois Attorney General (“AG”) filed a Complaint and Motion for Preliminary Injunction against TrueFlo Solutions LLC (“TS”) in White County Circuit Court in Illinois in regards to an oil spill that allegedly contaminated a creek.

TS is described in a September 8th news release as operating a commercial saltwater disposal facility in Carmi, Illinois.

The TS facility accepts saltwater containing saltwater brine and crude oil.

The facility’s processes are described as including disposal of saltwater brine from oil production by receiving the water created during production from off-site fields, separating out the brine and then transferring the material from the facility’s storage tanks to the pump house. The material is then stated to be pumped to an underground injection well.

The spill at issue is stated to have been found by Illinois Department of Natural Resources investigators who identified a trail of crude oil and damp soil at the pump house which led to the affected creek.

The AG states in the news release that she is seeking a preliminary injunction order to require the company to continue and improve cleanup operations. The Court is being asked to ensure that cleanup work continues 24 hours a day and require the company to compile a list of all residents and property owners who could be impacted by the spill. The motion also requests that TS:

  • Retain and work with a contractor specialized in crude oil remediation to determine the extent of the contamination
  • Document cleanup efforts and develop plans to continued remediation
  • Conduct sampling and provide status updates to the AG and the Illinois Environmental Protection Agency
