Risk Management Changes To Come Flooding In?

As we previously reported, the Federal Emergency Management Agency (“FEMA”) has been redrawing, “for the first time in three decades,” flood maps in the state of New York. With more than 500 miles of coastline and billions of dollars of real estate development along waterfronts throughout the state, these possible changes can impact the future look of New York.  However, as recent weather events have shown, being far from a coast does not guarantee a property is less likely to flood.

The New York State Department of Environmental Conservation (“DEC”) is currently seeking comments on two guidance documents under the Community Risk and Resiliency Act that deal with flood risk management.  Comments are being accepted through August 20, 2018.  A link to the proposals on the DEC website can be found here:  http://www.dec.ny.gov/enb/20180620_not0.html
