Stormwater Enforcement: Mississippi Commission on Environmental Quality and Oxford Development Enter into Agreed Order

The Mississippi Commission on Environmental Quality (“MCEQ”) and Pine Bluff Investments, LLC (“PBI”) entered into a March 26th Agreed Order (“AO”) addressing alleged violations of a stormwater general permit. See Order No. 7105 21.

The AO indicates that PBI is involved in a development titled Wellington Place (“Development”) located in Oxford, Mississippi.

The Development is apparently subject to a MCEQ Large Construction Stormwater General Permit. See MSR1074 (“Permit”).

The AO cites the following alleged violations at the Development:

  1. Violation of ACT3 Condition S-6 -Failure to submit Major Modification Form.
  2. Violation of ACTS Condition T-4 (1) -Failure to implement soil stabilization.
  3. Violation of ACT6 Condition S-3 (11)-Failure to maintain storm water controls.
  4. Violation of ACT6 Condition S-5 -Failure to conduct weekly inspections.

MCEQ is stated to have outlined for PBI certain corrective actions needed to bring the Facility back into compliance with the Permit. PBI asserted in March 11th email correspondence that it had completed the corrective actions and the Development was back in compliance.

The AO assesses a civil penalty of $22,250.
