But actions are needed from UK producers
On 28 November 2017, the UK Department for International Trade (DIT) announced that it would seek to maintain existing EU anti-dumping (AD) and anti-subsidy (AS) measures post-Brexit provided that the following conditions are met:
1. UK producers of the product(s) subject to the AD/AS measures (UK producers) have submitted an application requesting that the measures be continued;
2. Their application is supported by a sufficient proportion of UK producers (i.e., UK producers representing at least 50% of the total production of UK businesses either supporting or opposing the continuation of the AD/AS measures and UK producers representing at least 25% of total UK production of the relevant product(s)); and
3. Their market share is above a certain level (which remains to be clarified).
On 24 July 2018, the DIT published its provisional findings concluding that the aforementioned conditions were met for 42 of the existing AD/AS measures and recommending that these measures be maintained accordingly (see link for the provisional findings).
It is now up to UK businesses to provide comments on these provisional findings by responding to a dedicated questionnaire (see link) and sending their response to traderemedies@trade.gov.uk. The deadline to respond will lapse on 24 August 2018.
After this, the DIT will publish the definitive list of AD/AS measures that will be maintained by the end of the year (2018), at which point the (newly created) UK Trade Remedies Authority will review and adjust them to make sure that they duly reflect UK-specific market considerations.
