[Webinar] Mock Trial: Based on the Exemplary Civil and Administrative IP Cases of Shenzhen Court in 2021

China’s judicial reform continues to deepen, aiming to build a more transparent and effective system. As one of the crucial battle fields for IP right owners across the world, China has also established the IP courts and assembled top-notch judges to specially hear IP cases. To help our foreign clients to navigate this increasing complex legal landscape, we organize a mock trial endeavoring to present a real court trial in China.

Court trials in China are usually heard by a panel consists of three judges, except for major cases with significant influence. The presiding judge oversees the entire process of the trial, and the leading judge hears the specific issues of the case. Each party may designate one or two counsels. Due to pandemic, Chinese courts have introduced and are utilizing online trials so that litigation cases can be heard timely. This mock trial will be held as an online trial.

In this mock trial, the panel, each party and their counsels will all be played by the attorneys from Wei Chixue Law Firm and Linda Liu & Partners. The case being heard is actually based on the design infringement litigation case handled by the Firm (which is an Exemplary Civil and Administrative IP Cases of Shenzhen Court in 2021), for which we have obtained the consent of our client. By organizing this mock trial, we would like to introduce the procedures of online hearings of patent infringement lawsuits in China and methods of proving damages.

To accommodate different time zones, we are pleased to offer two sessions and please feel free to choose the date and time as you see fit.
