94th Arkansas General Assembly/Environmental Licensing/Permitting Fees: Legislation Introduced Proposing Amendments

Senator Irvin introduced Senate Bill 288 which would make certain revisions to sections of the Arkansas statute addressing environmental licensing and permitting fees.

The legislation also amends the statutory provision related to Wastewater Licensing Committee appointments.

Revisions to the licensing/permitting fees address the sections found in Ark. Code Ann. § 8-1-101 et seq. and include:

  • Timing of annual fees
  • Tying water permitting fees to not exceed reasonable administrative costs of evaluating and taking action on permit applications/implementing and enforcing the terms and conditions of permits and variances
  • Tying solid waste permitting fees for Class I and Class III landfills to revenues generated not to exceed the reasonable costs of evaluating and taking action on permit applications/implementing and enforcing the terms and conditions of permits and variances

Senate Bill 288 also amends Ark. Code Ann. § 8-5-201 et seq. is amended addressing:

  • Referencing Wastewater Licensing Committee appointments
  • Adjusting the wastewater licensing fees

Senate Bill 288 has been referred to the Public Health, Welfare and Labor Committee.
