The Arkansas Department of Energy & Environment – Division of Environmental Quality (“DEQ”) entered into a June 8th Consent Administrative Order (“CAO”) with Maverick Tube Corporation (“MTC”) addressing an alleged violation of a Clean Air Act Permit. See LIS No. 23-041.
The CAO provides that MTC owns and operates a pipe and tubing products manufacturing facility (“Facility”) in Blytheville, Arkansas.
The Facility is stated to operate pursuant to an air permit (“Permit”).
MTC is stated to have submitted a permit renewal application to DEQ on October 17, 2022. Such permit renewal application was deemed administratively complete on October 19, 2022. However, the permit renewal was stated to have been due by October 3, 2022. As a result, the CAO alleges that MTC failed to submit a complete application for permit renewal at least six months before expiration, violating General Provision 3 of the Permit.
MTC neither admits nor denies the factual and legal allegations contained in the CAO.
MTC is required to operate in accordance with the application it submitted on October 17, 2022, until such time the permit renewal becomes final.
A civil penalty of $1,200 is assessed.
