Air Enforcement: Tennessee Air Pollution Control Board Proposed Order Addressing Tullahoma Plastics Fabrication Facility

The Tennessee Air Pollution Control Board (“Board”) issued a June 21st proposed Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) to JSP International LLC (“JSP”) addressing violation of a Tennessee Air Regulations. See Case No. APC23-0019.

The Order provides that JSP operates a facility (“Facility”) in Tullahoma, Tennessee.

The Division of Air Pollution Control (“Division”) is stated to have received a Non-Title V Construction Permit application from JSP on January 5th for a 700-horsepower fire tube boiler. Further, the application is stated to have indicated that construction on the installation of the boiler began on January 2nd. The Division determined that JSP conducted the air contaminant source prior to applying for and receiving a construction permit.

The Division is stated to have sent a letter on January 20th to JSP indicating that the application was incomplete. A construction permit application was required to be submitted within 60 days of receipt of the letter to complete the application.

A Notice of Violation was issued to JSP on January 31st for allegedly constructing an air contaminate source prior to receiving a required permit.

The Division is stated to have received a revised APC100 form from JSP for a combined Non-Title V Construction and Operating Permit application on February 10th. It confirmed to JSP that the application was not complete.

The Order proposes a civil penalty of $4,500.

JSP is provided certain appeal rights.
