Amendment to Definition of Public Utility/92nd Arkansas General Assembly: Senate Bill 145 Proposes to Amend the Arkansas Renewable Energy Development Act of 2001

Senate Bill 145 has been introduced which would amend the definition of “public utility” to add an additional subdivision which would read as follows:

(J)     The term “public utility” does not include an entity that:

(i) Is a net-metering customer as defined in § 23-18-603;

(ii) Is a net-metering facility as defined in § 23-18-603; or

(iii) Develops, plans, installs, constructs, or otherwise provides a net-metering facility as defined in § 23-18-603 to a met-metering customer as defined in § 23-18-603;

Senate Bill 145 is sponsored by Senator David Wallace of Leachville, Arkansas.

The legislation would also address the phrases “net-metering customer” and “net-metering facility.”
