American Eagle Outfitters (American Eagle) settled a class action filed against it for alleged Telephone Consumer Protection Act (TCPA) violations for $14.5 million last week. The class action complaint alleged that American Eagle send unsolicited text message messages to over 600,000 unique cell phone numbers without prior written consent as required by the TCPA. The class consists of approximately 618,289 customers who claim to have received texts beginning in April 2010. Each class member who submits a “simple claim form” will receive between $142 and $285 from American Eagle. This settlement stems from the combination of separate class actions filed against American Eagle in New York, Florida, and Illinois. This settlement comes after over two years of litigation and the production of about 20,000 pages of documents in discovery. After all class members are compensated, any additional funds will be disbursed to the National Consumer Law Center.
