Asbestos/OSHA Enforcement: Proposed Assessment for Leawood, Kansas Contractor

The Occupational Safety and Health Administration (“OSHA”) issued a December 20th news release stating it was proposing penalties and issuing a Hazard Alert Letter to Compass Resources LLC (“Compass”) for alleged violations.

OSHA alleges that the Leawood, Kansas, contractor has exposed workers to asbestos and other workplace hazards.

A June 29th OSHA inspection is stated to have determined that Compass failed to:

  • Follow federal respiratory protection requirements
  • Provide drinking water and hygiene facilities
  • Remove damaged electrical cords

Compass is stated to be rehabbing the Firestone, Shankman and Michaelson buildings in Kansas City.

A Hazard Alert Letter is also stated to have been issued. It’s purpose is described as notifying an employer of an unsafe condition when the agency cannot prove a Section 5(a)(1) violation.

OSHA proposes to assess $223,000 in penalties.

Compass has 15 days from receipt of the citations and penalties to comply, request an informal conference with OSHA’s Area Director, or contest the findings before the Independent Occupational Safety and Health Review Commission.
