  • Democratic AGs from 20 states and the District of Columbia, led by California AG Rob Bonta, filed an amicus brief in the U.S. District Court for the Western District of Texas in support of the plaintiffs’ motion for preliminary injunction in Fund Texas Choice v. Paxton, urging the Court to halt enforcement of Texas’s abortion laws to the extent they prohibit interstate travel to access legal abortions.
  • In their brief, the AGs argue that attempts by Texas lawmakers to impose criminal and civil liability on Texans traveling out of state to access or provide legal abortion care amount to unconstitutional restrictions on interstate travel.
  • Specifically, the brief argues that an injunction would protect the health and liberty of the amici states’ residents who are temporarily in Texas as students, temporary workers, visitors, or for other reasons, and also would permit healthcare providers in Texas to travel to amici states where abortion is legal to provide services or accompany a patient in need of abortion care, without fear of prosecution.
