EEOC Announces Opening Date and Deadline for Submission of 2019 and 2020 EEO-1 Component 1 Data

The Equal Employment Opportunity Commission (EEOC) has announced that the annual Employer Information Report EEO-1 (EEO-1 Report) survey will open on April 26, 2021 to accept two years of Component 1 data and close on July 19, 2021.

On May 8, 2020, the EEOC delayed the opening of the 2019 EEO-1 Component 1 data collection due to the COVID-19 pandemic. On March 29, 2021, however, the EEOC announced that the 2019 and 2020 EEO-1 Component 1 data collection will open on April 26, 2021 and be due by July 19, 2021. The EEOC recognized the effect that the COVID-19 pandemic had on workplaces nationwide and the requirement to submit two years’ worth of EEO-1 data. Consequently, the EEOC extended the data collection by two weeks — extending time the portal will open to 12 weeks rather than its typical 10 weeks — to provide employers additional time to file their data.

The EEOC collects workforce data from employers and federal contractors meeting certain thresholds. Covered private employers with 100 or more employees (and federal contractors with 50 or more employees) must file annual EEO-1 Reports, which provide workforce headcount data by establishment location, gender and race/ethnicity. The EEOC has begun to formally notify previous EEO-1 filers via email of the opening of the 2019 and 2020 EEO-1 Component.

When the collection opens, additional resources will be available online at https://EEOCdata.org, and the Filer Support Team will be available to respond to filer inquiries.

Applicable employers should begin preparing to submit data in anticipation of the April 26 opening of the data collection period.
