EPA Proposes Adding Nine PFAS As Hazardous Constituents Under RCRA

On February 8, 2024, EPA published a proposed rule that would list the following nine PFAS as hazardous constituents under the Resource Conservation and Recovery Act (RCRA): PFOA, PFOS, PFBS, HFPO-DA (also known as GenX), PFNA, PFHxS, PFDA, PFHxA, and PFBA. If finalized, this rule would allow these nine PFAS to be included in RCRA facility assessments and further investigations and cleanup through the RCRA corrective action process. The proposed rule can be found here, and public comments on this proposed rule must be received by April 8, 2024.

On February 8, 2024, EPA proposed changes to the Resource Conservation and Recovery Act regulations by adding nine particular per- and polyfluoroalkyl compounds, their salts, and their structural isomers, to its list of hazardous constituents in Title 40 of the Code of Federal Regulations Part 261 Appendix VIII
