Ethylene Oxide Release/OSHA Enforcement: New Castle, Delaware Manufacturing Facility Proposed Penalty Assessment

The Occupational Safety and Health Administration (“OSHA”) issued a news release stating that Croda, Inc. has been proposed to be assessed penalties of $262,548.00 for alleged violations.

The alleged violations are stated to relate to the company’s New Castle, Delaware manufacturing facility.

OSHA is stated to have initiated an inspection after a chemical release at the facility exposed workers to ethylene oxide. The agency cited Croda, Inc. for violations which are alleged to include:

  • Deficient emergency action and response plans
  • Failure to train employees on how to manage ethylene oxide leaks
  • Failure to train employees on the use of fire protection, water deluge systems and emergency shutdown procedures
  • Failure to develop procedures for emergency responders to manage fire water amid an ethylene oxide release
  • Failure to provide employees respiratory protection

Croda, Inc. is stated to have requested an informal conference with OSHA, and to be working to reach a settlement.
