FIFRA Enforcement: U.S. Environmental Protection Agency and Fordyce, Nebraska, Cooperative Enter into Expedited Settlement Agreement

The United States Environmental Protection Agency (“EPA”) and Fordyce Farmers Non-Stock Cooperative (“FFNC”) entered into an April 3rd Expedited Settlement and Final Order (“ESA”) addressing an alleged violation of the federal Insecticide, Fungicide, and Rodenticide Act (“FIFRA”). See Docket No. FIFRA-07-2019-0145.

The ESA provides that FFNC operates an establishment assigned Establishment No. 73843 in Fordyce, Nebraska.

Section 7(c) of FIFRA requires any producer operating an establishment registered under Section 7 of the statute to inform EPA of the types and amounts of pesticide and, if applicable, active ingredients used in producing pesticides, which the producer is currently producing, which the producer has produced during the past year, and which the producer has sold or distributed during the past year.

FFNC is alleged to have failed to submit an annual Pesticide Production Report on or before March 1, 2018, for Establishment No. 73843-NE-1. This failure is alleged to be a violation of Section 7(c) of FIFRA.

A civil penalty of $800 is assessed.
