The new rule will allow worker representatives to take part in OSHA inspections even if they are not employees. The final rule clarifies that employee representatives may be an employee of the employer or a third party. The final rule is expected to take effect on May 31, 2024. Industry groups are expected to challenge the new rule in court. Criticism of the rule include concerns that the rule is designed to give unions access to non-union work sites in order to reach unrepresented workers.
