Pursuant to Colorado Statute, a document must be executed in the physical presence of a notary in order for the signature on the document to be notarized. This is true even where the document is electronically signed and electronically notarized. In order to address challenges imposed by COVID-19 pandemic social distancing requirements on such process, the Colorado Secretary of State, acting pursuant to an Executive Order from Governor Polis, has adopted temporary emergency rules allowing for remote notarization....
