Republican and Democratic AGs Square Up for Emissions Standards Fight

  • 25 Republican AGs have petitioned the U.S. Court of Appeals for the D.C. Circuit to review the EPA’s rule entitled “Multi-Pollutant Emissions Standards for Model Years 2027 and Later Light-Duty and Medium-Duty Vehicles” (“Standards”), which sets emissions standards for passenger cars, trucks, and vans, model years 2027-2032. The AGs argue that the EPA has exceeded its authority and the Standards are arbitrary and capricious.
  • A group of 23 Democratic AGs, joined by Denver, Chicago, Los Angeles, and New York, filed an unopposed motion to intervene in support of the EPA. In the motion, the AGs argue that they have standing and are entitled to intervene as a matter of right, because the states and cities are experiencing direct and compounding climate harms that are projected to worsen without reduction in emissions.
