Storage Tank Enforcement: U.S. Environmental Protection and Centralia, Washington Underground Storage Tank Owner Enter into Consent Agreement

The United States Environmental protection Agency (“EPA”) and Kenneth A. Stedham, d/b/a Bi-Rights Motor Company (“BMC”) entered into a May 15th Consent Agreement (‘CA”) addressing alleged violations of the Resource Conservation and Recovery Act Underground Storage Tank (“UST”) regulations. See Docket No. RCRA-10-1028-0256.

The CA resolves a Complaint filed by EPA against BMC on May 17, 2018.

EPA had alleged that BMC violated the UST regulations. Such violations are alleged to include the failure to permanently close a UST system as required by Washington Administrative Code 173-360-380 (4).

BMC neither admits nor denies the specific allegations contained in the Complaint.

The CA assesses a civil penalty of $1,000.
