Exposure to Unfair Competition Litigation in California -
Consumers and businesses alike have a powerful tool in California: the Unfair Competition Law (“UCL”), California Business and Professions Code §§ 17200–17209. The UCL Prohibits Unfair Competition – And It Is Very Broad -
The UCL forbids “unfair competition” including (1) any “unlawful” business act or practice; (2) any “unfair” business act or practice; (3) any “fraudulent” business act or practice; (4) any “unfair, deceptive, untrue or misleading advertising”; and (5) certain acts prohibited by the statute. Cal. Bus. & Prof. Code § 17200, et seq.
