Claims Against Spain and Italy as a Result of Alterations to their Renewable Energy Legislation -

In recent years, there have been a raft of Energy Charter Treaty (“ECT”) arbitrations commenced against Spain and Italy on behalf of renewable energy investors. King & Spalding currently represents investors in six ECT arbitrations against Spain and three against Italy, and are currently advising over a dozen others that have been affected by Spain’s and Italy’s changes to their renewable energy incentive schemes.

While the specific situation of each investor differs, and those differences can impact the strength of claims, this newsletter provides general insights regarding Spain’s and Italy’s amendments to their incentive schemes in the renewable energy sector.
