U.S. Ammonium Sulfate Manufacturers Win Relief from Unfair Imports from China

On February 8, 2017, the U.S. International Trade Commission (ITC) determined that domestic producers of ammonium sulfate are materially injured or threatened with material injury by reason of imports from China. As a result, antidumping and countervailing duty orders on ammonium sulfate from China will be imposed at rates previously set by the Commerce Department.

PCI Nitrogen, LLC (PCI Nitrogen) filed a petition against imports of ammonium sulfate from China on May 25, 2016. PCI Nitrogen secured affirmative preliminary determinations at the ITC in July 2016 and at the Commerce Department in November 2016.

In January 2017, the Commerce Department issued its final determinations that Chinese producers sold ammonium sulfate at prices less than fair value in the U.S. market and that those producers benefited from countervailable subsidies. The Commerce Department set a dumping margin of 493.46 percent and a countervailable subsidy rate of 206.72 percent for all Chinese producers in those determinations.

In response to the ITC’s 5-0 vote, PCI Nitrogen President Elio Mazzella, Sr. said, “We are very pleased with the ITC’s unanimous determination, which confirms that domestic producers and employees have been severely injured by the surge in dumped and subsidized imports from China. Today’s decision will help ensure that U.S. manufacturers and workers can compete with imports on an equal footing.”
