PAGA: Current Trends and Challenges

Since the Supreme Court’s blockbuster decision in Viking River Cruises v. Moriana, PAGA has been on every California employer’s mind. This session dives into the latest trends in PAGA litigation, discussing strategies for taking advantage of the positive trends and for managing the challenging ones. Topics include:

Arbitrability – What does Viking River really mean, and what can we expect in the coming months?
Manageability – State and federal courts are split on whether defendants can strike PAGA claims that are unmanageable. How should employers respond?
Multiple Claims – More and more, employers find themselves facing multiple, overlapping PAGA claims. What are the best strategies for handling this situation?

Arbitration: The Good, the Bad, and the Ugly

The sands of employment arbitration in California are constantly shifting under employers’ feet. In this session, our goal is to help place employers on sure footing by discussing the ins and outs of deciding whether to implement an arbitration program in the first place, how to draft an enforceable arbitration agreement, and what to do once your case is in arbitration. Topics will include the benefits and drawbacks of arbitration; the areas of risk when drafting and seeking to enforce employment arbitration agreements; and strategies for addressing the latest trends in employment arbitration law, including arbitration of PAGA claims post-Viking River, the ongoing battle over AB 51 and mandatory employment arbitration agreements, and the growing use of mass arbitrations.

Diversity, Equity, & Inclusion in Today's Workplace: Framing the Concepts Through a Legal Lens

DEI continues to expand its influence in the corporate world as business leaders take a critical look at how to best serve their constituents. We will lay the foundation for literacy on DEI concepts and vocabulary and address how DEI concepts relate to state and federal anti-discrimination laws.

Affirmative Action Plans in the Employment Setting: Legal Hurdles and Best Practices

Employers are increasingly creative and strategic when it comes to workforce diversity. Sometimes, however, the goal to improve diversity metrics can create unintended legal consequences. There are two competing strands: the desire to ensure underrepresented groups are fully considered in the recruiting and hiring process, and the legal requirement to make employment decisions that are not based on protected characteristics. How can employers accomplish the former without inadvertently violating the latter? Please join us as we discuss best practices for diversity-conscious employment initiatives.
