Employers face an increasing number of laws that limit when an employer may ask for and use an applicant's criminal history. "Ban the Box" laws prohibit questions about criminal history on the initial application. In addition, state legislatures are passing laws that restrict the kinds of convictions that employers may consider at any time during the hiring process. Together with the EEOC's enforcement guidance on disparate impact and the Fair Credit Reporting Act's more technical restrictions, these laws make an employer's consideration of an applicant's criminal history much more complicated.
