The Defend Trade Secrets Act recently passed in Congress is designed to expand the toolbox for trade secret protection, and it necessitates changes to agreements and policies with contractors, consultants and employees.

The BakerHostetler Noncompete and Trade Secrets practice team will be hosting a complimentary 60-minute webinar on Wednesday, July 20, 2016, at 1:00 p.m. ET, that will address the Act and its remedies, including the new ex parte seizure remedy. Hear from an expert with experience in implementing and overseeing seizures in hundreds of cases. Topics will include:

  • Overview of the Defend Trade Secrets Act;
  • How the Defend Trade Secrets Act compares to the Uniform Trade Secrets Act and strategic considerations for which to use;
  • The remedies available under the Defend Trade Secrets Act, including ex parte seizure orders;
  • Real-world examples of how to oversee and implement ex parte seizure orders under the Lanham Act, which forms the basis for the seizure provisions in the Federal Defend Trade Secrets Act;
  • The applicability of the inevitable disclosure doctrine under the Defend Trade Secrets Act versus the Uniform Trade Secrets Act; and
  • Revisions that need to be made to employment policies and nondisclosure agreements to take full advantage of the remedies available under the Defend Trade Secrets Act, including timing and suggested language recommendations.
