Electronic information in various forms is now a common feature in the investigation and prosecution of crimes. The search for and use of that information presents issues under the Fourth, Fifth, and Sixth Amendments as well as, among other things, discovery, and admissibility.
This presentation will examine the applicability of these amendments as well as other topics related to criminal matters. Topic to be addressed include:
- The Fourth Amendment and electronic information
- The Fifth Amendment privilege against self-incrimination and electronic information
- Sixth Amendment right of confrontation when electronic information is offered into evidence
- Discovery and admissibility of electronic information
