Mintz, Levin, Cohn, Ferris, Glovsky and Popeo - Antitrust & Federal Regulation Practice

Practice/Organization Description

ANTITRUST

Mintz Levin's antitrust practice spans the entire spectrum of work in the field, including counseling clients on antitrust issues affecting business relationships and the structure or outcome of a transaction; handling transactions of the size and scope that draw the attention and scrutiny of federal entities; and litigating antitrust cases, including criminal antitrust matters. Consistent with the firm's strong presence in the technology, communications, biotechnology, and health industries, much of our work has involved addressing cutting-edge questions pertaining to these fields.

Our antitrust practice attorneys represent large corporations, not-for-profit entities, joint ventures, and small businesses, including multibillion dollar companies in global antitrust and competition-related matters, in industries as diverse as banking, biotechnology, communications, e-commerce, and health care. In addition to the over 100 years of antitrust experience our most senior antitrust practitioners possess, several have held important positions at the Antitrust Division of the Department of Justice and at the Federal Trade Commission. Our practitioners have written and spoken about important and novel antitrust questions around the world.

FEDERAL REGULATION

We are experienced in interacting with both the executive and legislative branches of government, dealing with a wide range of regulatory agencies and issues, and effectively challenging governmental decisions in court or administrative proceedings. We pride ourselves on assisting clients in understanding federal policies and regulations and influencing the development of federal law by anticipating and dealing with governmental action that might adversely impact their interests.

Our Federal Relations practice involves:

- representing a diverse group of individuals, businesses, and trade associations before Congress,

- involvement in executive branch and agency proceedings and

- rulemakings, and regulatory counseling and federal litigation matters.

Having served in a variety of official capacities, our attorneys bring experience from all three branches of the Federal Government. This experience is brought to bear when counseling clients how to solve or avoid problems, obtain a necessary governmental action, or obtain insights into governmental activity in order to conduct business affairs.

Our Washington DC office maintains an active legislative practice across a broad cross section of issues and key Congressional committees. We also frequently deal with the following agencies:

Department of Justice

Federal Communications Commission

Environmental Protection Agency

Department of Health and Human Services

Federal Trade Commission

Consumer Product Safety Commission

Office of the U.S. Trade Representative

Food and Drug Administration

Nuclear Regulatory Commission

Securities and Exchange Commission

Several former government officials currently on our staff provide valuable perspective and firsthand experience to our federal representation. Charles D. Ferris, chairman of the Washington DC office, previously served as chairman of the Federal Communications Commission and as chief counsel to the Senate Majority Leader and the Speaker of the House. Several members of the office are alumni of the White House staff from the Carter, Reagan, and Bush Administrations, while others served as chiefs of Capitol Hill staffs.

Our most senior litigators in Washington bring to their practices the perspective of federal judicial clerkships and decades of experience in federal court litigation. Please contact Bruce Sokler if you would like to know more about our Antitrust & Federal Regulation Practice.
