This presentation covered the legal issues involved in a trustee’s duty to disclose as that duty is defined in the relevant trust document, statutes, common law, and discovery rules. The presentation also addressed the ramifications for a trustee not complying with its duty to disclose and methods for a trustee to resolve disputes regarding the duty to disclose.
