  • A bipartisan coalition of 23 AGs responded to the National Telecommunications and Information Administration’s (NTIA) request for comment on artificial intelligence (AI) system accountability measures and policies.
  • The letter recommends a risk-based approach to AI regulation—in which AI systems with a greater potential impact on safety, rights, or equal access are given more oversight than those engaging in lower-risk activities—and also emphasizes the need to encourage or mandate transparency when AI is used in high-risk activities; advocates for periodic testing and assessment for high-risk AI systems; and highlights the need for federal legislative oversight of AI.
  • The AGs assert that they should have concurrent enforcement authority in any federal regulatory regime governing AI, and the AGs assert an interest in reviewing any standards or recommendations the NTIA puts forward based on the request for comment.
