Air Enforcement: Arkansas Department of Energy and Environment - Division of Environmental Quality and City of Wynne Enter into Consent Administrative Order

Mitchell, Williams, Selig, Gates & Woodyard, P.L.L.C.

The Arkansas Department of Energy and Environment - Division of Environmental Quality (“DEQ”) and City of Wynne, Arkansas (“Wynne”), entered into a November 4th Consent Administrative Order (“CAO”) addressing an alleged violation of an air permit. See LIS No. 21-115.

The CAO provides that Wynne owns and operates an air curtain incinerator in Cross County, Arkansas.

The air permit relevant to the CAO is a General Air Permit for Title V Air Curtain Incinerators 2370-AGP-000 (“Permit”). The Permit was stated to have been issued to Wynne on September 8, 2020.

DEQ personnel are stated to have conducted an inspection of Wynne’s facility covering the reporting period of September 9, 2020, through February 28, 2021. They are stated to have observed open burning of municipal yard waste on the grounds outside of the air curtain incinerator. This is alleged to have caused the emission of air contaminants constituting air pollution. Specific Condition 5 of the Permit was allegedly violated.

DEQ is stated to have informed Wynne of the alleged compliance issue.

Wynne neither admits nor denies the factual and legal allegations contained in the CAO.

A civil penalty of $980 is assessed.
