The Arkansas Department of Energy and Environment – Division of Environmental Quality (“DEQ”) and United Industries, Inc. (“United”) entered into a May 15th Consent Administrative Order (“CAO”) addressing an alleged violation of an Air Permit. See LIS No. 24-091.
The CAO provides that United owns and operates a foam board sign manufacturing facility in Bentonville, Arkansas.
The facility is stated to operate pursuant to an Air Permit.
DEQ is stated to have conducted a compliance inspection of the facility on November 14, 2023. The inspection covered the reporting period of November 2022 through October 2023. Further, a follow-up inspection was conducted on November 20, 2023, to clarify certain issues.
The inspection is stated to have determined that the facility exceeded the 9.7 tpy VOC emission rate limit at SN-03 during 2023. This violated Specific Condition 1 of the Permit.
United stated during the inspection that the increase in VOC emissions was due to increased use of isopropyl alcohol at the facility.
United neither admits nor denies the factual and legal allegations contained in the CAO.
The CAO requires that within 30 calendar dates of its effective date that United submit a Title V Permit Application to DEQ to raise the SN-03 in the facility-wide VOC emission limit.
