Air Enforcement: Arkansas Department of Environmental Quality and Izard County, Arkansas, Hardwood Flooring Mill Enter into Consent Administrative Order

The Arkansas Department of Environmental Quality (“ADEQ”) and Unilin North America, LLC, (“Unilin”) entered into a March 13th Consent Administrative Order (“CAO”) addressing alleged violations of an air permit. See LIS No. 18-026.

The CAO provides that Unilin owns and operates a hardwood flooring mill located in Izard County, Arkansas.

The CAO references Air Operating Permit 0559-AOP-R8.

Unilin is stated to have submitted a stack test report to ADEQ on June 12, 2017, for emissions testing conducted April 4, 2017. The test results are stated to have indicated that Deltak Wood-Fired Boiler (SN-05) exceeded the permitted emissions rate limit for Carbon Monoxide (“CO”). The permitted emissions rate for CO at SN-05 is stated to be 21.7 lb/hr. The average emissions rate of CO recorded at SN-05 during the emissions test was 40.62 lb/hr. These emissions are alleged to be a violation of Specific Condition 6 and 10 of the Air Permit.

Unilin is stated to have submitted a Permit Modification Application to ADEQ on April 28, 2017. The application is stated to have requested that the CO emissions rate limits for SN-05 be increased from 21.7 lb/hr. to 55.8 lb/hr and from 95.0 tons per year to 244.2 tons per year.

The previously referenced application is stated to have been deemed administratively complete on May 8, 2017.

ADEQ is stated to have issued Air Permit 0559-AOP-R9 on November 6, 2017, which included the increased CO emissions rate limit for SN-05.

Unilin neither admits nor denies the factual and legal allegations contained in the CAO.

The CAO assesses a civil penalty of $1,000.
