The Tennessee Air Pollution Control Board (“Board”) issued a November 1st proposed Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) to Assurance Operations Corporation d/b/a AOC Metal Works (“Assurance”). See Case No. APC22-0090.

The Order provides that Assurance operates a metal fabrication operation (“Facility”) in Lawrenceburg, Tennessee.

The Facility is stated to have been issued a True Minor Operating Permit (“Permit”) in 2015 for the metal fabrication operation. The Permit included a requirement to provide an annual certification and compliance report.

The Order states that Assurance failed to provide an annual National Emissions Standards for Hazardous Air Pollutants 40 CFR Part 63, subpart XXXXXX report (“Report”) for 2021 to the Division of Air Pollution Control by the required date of January 31, 2022. As a result, it is alleged that Assurance violated Condition 12(2) of the Permit.

The Division of Air Pollution Control is stated to have received Assurance’s Report on April 26th.

A civil penalty of $1,500 is proposed to be assessed.

The Order provides certain appeal rights.

A copy of the Order can be downloaded here.
