The City of Las Vegas, along with the City of Henderson and Clark County, had previously authorized restaurants to sell alcohol via special “to go” permit for curbside pickup (with food orders). However, the City of Las Vegas is also now allowing restaurants and other businesses with food services licenses that hold existing alcohol licenses to obtain an alcohol delivery permit during the period in which the emergency limitations on in-house dining remain in effect. The permit is subject to the following conditions:
- Allows businesses with an existing alcohol license and food service to deliver alcohol with a meal;
- Commercial locations only;
- Can only sell type of alcohol that they are currently licensed for (e.g. beer/wine licensee may only offer beer and wine with their take-out meal);
- Alcoholic beverages must be in the manufacturer’s original sealed container (no mixed drinks or cocktails);
- Alcoholic beverages must be delivered by the owner or employee of the business; third-party delivery service (i.e. DoorDash, UberEats, etc.) is not allowed;
- The person delivering must verify that the person accepting the delivery is at least 21-years-old;
- Employee delivering MUST have an unexpired alcohol awareness card (TAM card) and a Las Vegas Metropolitan Police work card (Sheriff’s card); and
- Owners and key employees previously registered with the City do not need a Sheriff’s card, but must nevertheless have a valid TAM card.
Based upon precedent, we may see Clark County and the City of Henderson follow suit and also adopt similar delivery provisions for businesses currently licensed to sell alcohol.
