President Obama Signs Outpatient Status Notification Bill On August 6, 2015, President Obama signed the Notice of Observation Treatment and Implication for Care Eligibility (NOTICE) Act.  This legislation requires hospitals to provide specific notice to patients who receive outpatient observational services for more than 24 hours.  For a previous Health Headlines article summarizing this legislation, please click here.

CMS Extends Delay in Two-Midnight Rule Enforcement CMS has announced it will extend the partial enforcement delay of the two-midnight rule through the end of 2015 and will not approve Recovery Audit Contractors to conduct patient status reviews for dates of admission October 1, 2015 through December 15, 2015.

HHS Issues Proposed Rule For Faith-Based or Religions Organizations On August 6, 2015, HHS issued a proposed rule that, among other things, requires faith-based or religious organizations administering a program supported with direct HHS financial assistance to provide beneficiaries with a written notice informing them of their religious liberty protections.  The proposed rule is available here.

King & Spalding Rountable on Recent Stark Developments On Wednesday, September 2, 2015, King & Spalding will host a Roundtable to discuss recent Stark law developments, including the Fourth Circuit's recent Tuomey decision, emerging whistleblower and government enforcement theories, and newly proposed Stark rules.  Given the recent flurry of Stark law activity, the time is right to recap the developments and discuss how the current environment may shape Stark compliance strategies.  The program will be presented by a panel of King & Spalding experts who focus on Stark law compliance advice, transaction structuring, voluntary disclosures and qui tam litigation defense.  Additional information about this Roundtable, including registration instructions, will be published in an upcoming edition of Health Headlines.
