On April 2, 2025, the Department of Commerce’s Bureau of Industry and Security issued a draft Federal Register notice adding cans of beer and empty aluminum cans to the list of aluminum “derivative” products subject to tariffs pursuant to Section 232 of the Trade Expansion Act of 1962. Today’s announcement is a follow-on to the President’s February 10, 2025, Proclamation imposing Section 232 tariffs on a broad range of derivative products listed in the Annex to the Proclamation. Imports of empty aluminum cans imported under Harmonized Tariff Schedule (“HTS”) code 7612.90.10 will now be subject to 25% tariffs. The value of aluminum content for cans of beer imported under HTS code 2203.00.00 will be subject to 25 percent tariffs. The duties will apply to entries made for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern daylight time on April 4, 2025. All other tariff codes for aluminum and aluminum derivative products provided for in the Annex to the President’s February 10, 2025, Proclamation remain unchanged.
