April 14, 2025 Update: U.S. Department of Education Title VI Certification Requirement

On Friday, April 11, 2025, the Ohio Department of Education and Workforce (ODEW) sent an update regarding the Title VI Certification required to be filed by districts by 11:59 p.m. on Friday, April 18, 2025. ODEW confirmed that the deadline to file the certification has not been extended, despite an agreement reached in the case of National Education Association v. U.S. Department of Education, pending in the United States District Court for the District of New Hampshire, which includes the USDOE’s agreement that Title VI certifications will not be effective until after April 24, 2025 and that it would not take any enforcement action based on the certification, or lack thereof, filed by districts until after April 24, 2025.

Thus, districts should take care to undertake adequate due diligence efforts to review its records, programs and practices this week so that it is in a position to file the certification on or before April 18, 2025, at 11:59 p.m. If you have questions about what is recommended, please see Roetzel’s client alert issued on April 11, 2025.
