Baby Food Manufacturer Rapped for Allegedly Misrepresenting Products as Lead-Free

New York AG Letitia James issued a demand letter to baby food company JSG Babyfood LLC, doing business as HolleUSA, ordering it to stop using false or misleading claims in its marketing in violation of New York’s consumer protection and deceptive business practices laws.
The letter orders HolleUSA to cease advertising its products as being lead-free and having no detectable levels of heavy metals, noting that lab tests ordered by the AG’s office found traces of heavy metal in each of the 18 HolleUSA baby food pouches tested. The letter notes that the AG’s office has the authority to bring an action to enjoin fraudulent or deceptive business practices, and to seek restitution, damages, and civil money penalties.
As previously reported, a group of 23 Democratic AGs led by AG James petitioned the FDA to issue interim proposed action levels for heavy metals in all categories of infant and toddler foods and issue guidance to the baby food industry that manufacturers should test finished products to limit the concentration of four heavy metals in their baby food products.
