C & H Hog Farms (Newton County, Arkansas): Buffalo River Watershed Alliance, Inc.'s Motion to Intervene in Arkansas Pollution Control and Ecology Commission Proceedings

The Buffalo River Watershed Alliance, Inc., Arkansas Canoe Club, Ozark Society, Inc., and Five Individuals (collectively “BRWA”) filed a December 18th Motion to Intervene and Request for Hearing (“Motion”) in C & H Hog Farm’s (“C & H”) Request for Adjudicatory Hearing and Commission Review/Stay (“Request”).

C & H is challenging the Arkansas Department of Environmental Quality’s (“ADEQ”) denial of an application for a Regulation 5 Permit. (See previous post here.)

The five individuals that are included in the BRWA Motion include Gordon Watkins, Marti Olesen, Dr. Alan Nye, Robert Cross, and Dr. David Peterson.

BRWA’s Motion argues that it satisfies the Arkansas Pollution Control & Ecology Commission Regulation No. 8 Standards of Permissive Intervention and is entitled as a matter of right to intervene. It further states that it supports ADEQ’s final permitting decision denying C & H’s application for a Regulation No. 5 Permit.

The C & H facility involves the operation of a swine facility in Newton County, Arkansas. Regulation No. 5 addresses liquid animal waste management systems.

The company and ADEQ are also involved in judicial litigation over previously denied permits for which the facility holds and/or has applied.
