Precedential Federal Circuit Opinions

  1. IN RE: THE BOARD OF TRUSTEES [OPINION] (2020-1288, 3/25/2021) (Prost, Lourie, Reyna)
Reyna, J. Affirming rejection of claims related to genetic analysis because they were drawn to abstract math. “The different use of a mathematical calculation, even one that yields different or better results, does not render patent eligible subject matter…  Nor is novelty the touchstone of patent eligibility. That a specific or different combination of mathematical steps yields more accurate haplotype predictions than previously achievable under the prior art is not enough to transform the abstract idea in [the claim] into a patent eligible application.”
