Clean Water Act Enforcement: U.S. Environmental Protection Agency and Redding, California Fuel Transport Company Enter into Consent Agreement

The United States Environmental Protection Agency (“EPA”) and Shasta-Siskiyou Transport (“SST”) entered into a May 30th Consent Agreement (“CA”) addressing alleged violations of the Clean Water Act. See Cwa-09-2024-0042.

The CA provides that SST is a commercial fueling transport company with an address in Redding, California.

SST is stated to be or was an owner or operator within the meaning of Section 311(a)(6) of the Clean Water Act.

The CA provides that an SST tanker truck was carrying TransMix (a mixture of gasoline, diesel fuel, and other petroleum distillates), in downtown Redding, California in 2022 when it overturned. The tanker truck is stated to have been damaged and discharged TransMix into nearby storage drains including drains which lead directly into Calaboose Creek and subsequently into the Sacramento River. Such oil that is stated to have been discharged into or upon the Sacramento River, in turn flowed into the San Francisco Bay and the Pacific Ocean, each of which is a navigable water of the United States as defined in Section 502(7) of the Clean Water Act.

The CA alleges that the overturned tanker truck is stated to have discharged oil in such quantities as may be harmful as defined in 40 C.F.R. § 110.3(b), into or upon the navigable waters of the United States and adjoining shorelines in violations Section 311(b)(3) of the Clean Water Act.

The CA assesses a Civil Penalty of $208,840.46.
