Andrews, J. Court affirms magistrate’s report and recommendation denying sanctions.

Plaintiff objects to the magistrate’s ruling declining to award sanctions for defendant’s failure to produce IDV data. Plaintiff contends that the IDV data is the only evidence that definitively addresses defendant’s argument that its pre-fabrication modeling results are not correlated to the manufactured products. The magistrate found that data that had been produced provided the precise measurements of the actual process parameters and therefore there was no prejudice. The court affirms.
